Instructions for Hiring Departments

Before submitting the application to the International Services office, hiring departments must consider the following:

  • RBHS will only sponsor for H-1B status individuals in regular, full-time positions.
    Examples of such positions are as follows:

    • Research Teaching Specialists
    • Research Associates
    • Faculty Appointments (i.e.: Instructor, Associate Professor, Professor, etc)

  • Individuals in temporary, part-time, or unpaid positions do not qualify for H-1B sponsorship.

  • Beneficiaries may not begin employment at RBHS without first receiving written approval from the USCIS for such employment.

  • Volunteering for research positions is not permitted at RBHS.

  • Beneficiaries who are currently in the U.S. under the H-1B status may begin/continue employment at RBHS for a period of up to 240 days while an application for transfer/extension is being processed, provided the petition has been submitted to the USCIS in a timely fashion and prior to the expiration date on the current H-1B approval. Please note that the employment may only begin once RBHS has received a receipt notice from the U.S. Citizenship & Immigration Services.

  • The sponsoring department is required to inform International Services of any substantive changes to the employee's job description, changes in work location, or transfers prior to the change taking effect.

  • All events pertaining to the H-1B employee's stay at RBHS, including arrival and termination of employment, must be reported immediately by the sponsoring department to International Services. The sponsoring department must inform International Services immediately upon departure of the H-1B participant, regardless of whether or not the departure was planned.

  • The sponsoring department is required to pay the reasonable travel expenses for the applicant's return to his/her last country of residence, if the employment is terminated by RBHS prior to the expiration date of the H-1B approval.

  • USCIS fees for the H-1B application are the responsibility of the sponsoring department. Fees for dependent applications are the responsibility of the employee.

  • Outside attorneys are not authorized to file H-1 petitions of behalf of RBHS. All H-1 petitions must be filed by International Services. Applications filed by outside attorneys will be withdrawn.
